During a recent roundtable on the increased rate of AI adoption in legal practice, the importance of setting secure guardrails around accuracy, confidentiality and explainability was high up the agenda. The consensus was clear: innovation must advance \u2013 but only with guardrails strong enough to maintain trust.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

\n\t\t\t\t\t\t\t\t\t

AI has become a foundational technology across industries.\u00a0<\/span>However, the legal profession has looked like a possible outlier, given the high risks associated with sensitive data, client confidentiality and the consequences of inaccuracy.<\/span><\/p>

Not\u00a0any more.\u00a0<\/span>Over the last year especially<\/span><\/a>, many law firms have shifted their view on AI innovation. The opportunities presented by AI, including rapid data search, document analysis, drafting automation, quality assurance for decision-making and analytics-driven compliance, are simply too valuable to ignore.<\/span><\/p>

Pressure from clients on firms to invest in cost-saving technologies is growing, with the understanding that General\u00a0Councils\u00a0might turn to a rival firm or take business in house.\u00a0<\/span>AI efficiencies may accelerate the evolution of financial models from billable hours to value-based pricing.\u00a0<\/span>Y<\/span>ounger, tech-savvy lawyers may also gravitate towards those firms that encourage the use of\u00a0cutting-edge\u00a0applications.\u00a0The question is no longer whether to use AI,\u00a0but how to do so responsibly.<\/span>\u00a0<\/span><\/p>

Despite growing enthusiasm, the risks associated with AI remain substantial. Rigorous protection of client data and the firm\u2019s intellectual property must remain highest priority. These can\u2019t be compromised in the name of \u2018progress\u2019.<\/span><\/p>

Any AI-related security breach or data privacy violation will prove extremely costly, while a firm found to be \u2018cutting corners\u2019 with AI risks severe and lasting reputational damage.\u00a0Over-reliance on AI will result in sloppy mistakes.\u00a0<\/span>\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The challenge for legal organisations is to innovate without compromising on security,\u00a0ethics\u00a0or professional standards. This requires not only new tools, but\u00a0updates to\u00a0governance, operating\u00a0procedures\u00a0and\u00a0the company\u00a0culture.<\/span><\/p>

However, this noble intention is easier said than done.\u00a0<\/span>Governance in legal practice is notoriously complex, especially when the tools are continually changing (and insurer requirements are shifting in step). Firms often have many levels of use authorisation. Deciding the right limits on guardrails is a delicate task.<\/span><\/p>

Yet, despite the\u00a0trials around AI, the cost of\u00a0delay\u00a0is rising. Firms that hesitate risk falling behind clients,\u00a0competitors\u00a0and regulators.<\/span>\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Getting\u00a0out ahead of regulation: a strategic advantage\u00a0<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Government regulation and industry standards traditionally provide the guardrails to ensure technological innovation is pursued in a responsible way. <\/span>In the UK,\u00a0s<\/span>olicitors and registered lawyers are obliged by the SRA to \u201c<\/span>maintain their competence to carry out their role<\/span><\/a>\u201d which includes keeping relevant knowledge and skills up to date. Ignoring AI could therefore prove negligent.\u00a0<\/span>\u00a0<\/span><\/p>

Enterprises\u00a0across all industries worldwide are following guidance on\u00a0<\/span>Responsible AI<\/span><\/a>\u00a0from respected providers such as the\u00a0<\/span>Risk Management Framework<\/span><\/a>\u00a0from the NIST\u00a0<\/span>(National Institute of Standards and Technology)\u00a0<\/span>in the US,\u00a0<\/span>the EU AI Act<\/span><\/a>\u00a0in Europe and the\u00a0<\/span>ISO 42001 standard<\/span><\/a>.<\/span><\/p>

While compliance to\u00a0one of these\u00a0industry standards is not mandatory, it<\/span>\u00a0is becoming a de facto requirement driven by client demands and insurer requirements. Compliance is also seen as a benchmark for due diligence in legal cases, while\u00a0demonstrating\u00a0a commitment to mitigate risk in a market environment that typically moves faster than formal regulation.\u202f<\/span><\/p>

Big corporations such as McDonald\u2019s have\u00a0<\/span>decided to get out ahead of compliance<\/span><\/a> by developing their own principles and frameworks that provide a buffer against change.<\/span><\/p>

For law firms\u00a0\u2013\u00a0where risk exposure is higher \u2013\u00a0the case for proactive governance is even stronger.<\/span>\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Drawing out the non-negotiable red lines\u00a0<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

As a priority, firms should draft an internal AI policy that clearly sets out acceptable and unacceptable uses. <\/span>\u00a0<\/span><\/p>

Any\u00a0Responsible AI\u00a0policy should include guidance on so-called \u2018shadow AI\u2019 \u2013\u00a0i.e.,\u00a0when staff develop their own applications or use non-sanctioned platforms to carry out official work.\u00a0<\/span>\u00a0<\/span><\/p>

AI tools are increasingly joining processes and meetings as a matter of course, such as transcription services or office assistants like Microsoft Copilot that automatically fire off actions to people mentioned in the dialogue.\u00a0Firms must\u00a0determine\u00a0where these tools add value and where they introduce vulnerabilities.<\/span>\u00a0<\/span><\/p>

The risks of data mismanagement or confidentiality breach are potentially higher on unvetted systems. At the same time,\u00a0it\u2019s\u00a0worth investing time in understanding exactly why people will try to circumvent the rules. What are their personal preferences and drivers? What\u00a0could\u00a0the firm\u00a0be\u00a0missing out on? By taking an open mind, these innovations\u00a0might\u00a0be accommodated within the perimeter for others to use.\u00a0<\/span>\u00a0<\/span><\/p>

The key is to install the necessary guardrails to protect data and IP, while also\u00a0demonstrating\u00a0to insurers that the AI stack is sufficiently\u00a0monitored\u00a0and controlled.\u00a0<\/span>\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The law needs humans to stay in the loop\u00a0<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Rather than leave IT to manage the risks of AI alone, it\u2019s vital that all functions take ownership<\/span>. (Some firms are now hiring AI specialists to lead adoption across functions.)<\/span><\/p>

Lawyers themselves are especially important, given their knowledge on technical areas of law and the need to stress test systems for accuracy.<\/span><\/p>

Data governance is at the heart of AI governance. Put the right standards in place, and responsibility will endure no matter how technology advances.\u00a0<\/span>This groundwork is especially timely given the growing sophistication of agentic AI.<\/span><\/p>

Firms need to know that AI won\u2019t replace lawyers. Despite rapid advancements, AI still generates inaccurate and fabricated information. Biases or discriminatory patterns in training data can become engrained, leading to unjust decisions. Then there are the grey areas of legal interpretation, which are so important to fairness and justice on a case-by-case basis.<\/span><\/p>

AI lacks the transparent reasoning and nuanced understanding to reflect client needs or convey jurisdictional subtleties. The \u2018black box\u2019 nature of AI removes essential explainability. In short, AI is still no substitute for human rationale.\u00a0<\/span><\/p>

By leading with Responsible AI, law firms can innovate confidently, create competitive\u00a0advantage\u00a0and\u00a0maintain\u00a0the trust on which legal practice depends. The firms that build strong foundations today will be best positioned to harness future waves of AI\u00a0\u2013\u00a0while keeping\u00a0lawyers\u00a0at the helm.<\/span>\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t
